Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding legal agreement between you ("you", "user") and Socialfame LLC ("Socialfame", "we", "us"), a limited liability company organized under the laws of the State of Delaware, United States, regarding your use of the LEADS mobile application (the "App") and the website at tryleads.app (the "Site", together with the App, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use the Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

The Service is not available to users in jurisdictions where it would violate applicable laws.

3. Account

To use most features of the Service, you must create an account. You agree to:

  • Provide accurate and current information.
  • Keep your password confidential and secure.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and payments

4.1 Plans

The Service offers a Free plan and Premium subscription plans. Current pricing is listed at tryleads.app/pricing and within the App.

  • Free plan: limited features, no payment required.
  • Premium Monthly: €7.99 / month (price may vary by region; see App Store for exact local price).
  • Premium Yearly: €59.99 / year (price may vary by region).

4.2 Payment processing

All payments are processed by Apple through the App Store. We do not directly process payments. Your payment method on file with Apple will be charged.

4.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Renewal is processed at the then-current price. You can manage and cancel your subscription in your Apple ID settings.

4.4 Refunds

Refunds are handled by Apple in accordance with the Apple Media Services Terms. We do not directly issue refunds. You can request a refund from Apple at reportaproblem.apple.com.

4.5 Free trial (if applicable)

If we offer a free trial, the trial converts to a paid subscription automatically at the end of the trial period unless canceled before then.

4.6 Price changes

We may change prices for Premium subscriptions. We will notify existing subscribers at least 30 days before a price change takes effect. If you do not agree, you may cancel your subscription before the new price applies.

5. License to use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or business sales activities, subject to these Terms.

6. Restrictions

You agree not to:

  • Use the Service for any illegal, fraudulent, or harmful purpose.
  • Reverse-engineer, decompile, or attempt to extract the source code of the App.
  • Use the Service to send spam, harass, or stalk individuals.
  • Use the Service to manage data that you do not have the legal right to process (e.g. scraped contact lists obtained without consent).
  • Impersonate another person or misrepresent your affiliation.
  • Attempt to gain unauthorized access to other users' accounts or our infrastructure.
  • Use automated means (bots, scrapers) to interact with the Service.
  • Resell, sublicense, or commercially exploit the Service without our written permission.
  • Use the Service to train, fine-tune, or develop competing AI models or sales coaching products.

We reserve the right to suspend or terminate your account for violation of these restrictions.

7. Your data

You retain full ownership of the lead data and content you input into the Service. We do not claim ownership of your data.

By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you (storing, displaying, generating AI suggestions, etc.). We will not use your data for any other purpose.

8. AI features (Leadsy)

Leadsy provides AI-generated suggestions to assist your sales activities. You acknowledge and agree that:

  • AI-generated content is suggestion only, not professional advice.
  • You are solely responsible for what you do with Leadsy's suggestions, including messages you send to your leads.
  • AI can make mistakes. You should review and edit AI suggestions before acting on them.
  • We do not guarantee any specific outcome (e.g. closed deals, increased revenue) from using Leadsy.

You agree not to rely on Leadsy for legal, medical, financial, or other regulated professional advice.

9. Service availability

We strive to maintain high availability but do not guarantee that the Service will be available 100% of the time. We may suspend the Service for maintenance, updates, security incidents, or force majeure events.

We will notify you of planned maintenance through the App or by email when possible.

10. Intellectual property

The Service, including the App's code, design, trademarks (LEADS, Leadsy), text, graphics, and underlying technology, is the exclusive property of Socialfame LLC and is protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

11. Termination

11.1 Termination by you

You can stop using the Service at any time. To delete your account permanently, use the in-app option (Settings → Account → Delete account) or email us at hello@tryleads.app.

11.2 Termination by us

We may suspend or terminate your access to the Service if you violate these Terms, abuse the Service, or fail to pay for a subscription. We will generally provide notice before termination, except in cases of severe violation.

11.3 Effect of termination

Upon termination, your access to the Service ends. Your data will be deleted within 30 days, except as required by law. Sections that by their nature should survive (e.g. liability limitations, intellectual property, dispute resolution) will survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES.

WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NOTHING IN THIS SECTION LIMITS YOUR STATUTORY RIGHTS UNDER APPLICABLE CONSUMER PROTECTION LAW (E.G. EU CONSUMER RIGHTS, FRENCH CONSUMER CODE).

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALFAME LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).

NOTHING IN THESE TERMS LIMITS LIABILITY FOR (I) GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, (II) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, (III) FRAUD, OR (IV) ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

14. Indemnification

You agree to indemnify and hold harmless Socialfame LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Service in violation of these Terms, (b) your violation of any third-party rights, or (c) content or data you input into the Service.

15. Governing law and dispute resolution

15.1 For users in the European Union

These Terms are governed by the laws of France, without regard to conflict-of-laws principles. Any dispute will be subject to the exclusive jurisdiction of the competent French courts, except where mandatory consumer protection laws grant you the right to bring proceedings in your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform.

15.2 For all other users

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, USA.

16. Changes to these Terms

We may modify these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the new Terms, you must stop using the Service.

17. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Socialfame LLC regarding the Service and supersede all prior agreements.

If any provision is found to be unenforceable, the remaining provisions remain in full force.

Our failure to enforce any right is not a waiver of that right.
